What is the principal legislation under which the real estate sector operates in NSW?

The Property, Stock and Business Agents Act 2002 and Regulations 2003.


What is a Certificate of Registration?

A Certificate of Registration is issued by the OFT to a real estate salesperson / property manager. It allows the holder to perform the functions of a real estate agent in specific areas of the industry, under the supervision of a licensee-in-charge.

Do I need a Certificate of Registration?

If any aspect of your work requires you to exercise any of the multiple functions for which a real estate agent is licensed, such as those listed below, then you require a Certificate of Registration. Check with the OFT if you aren’t sure.


Below are some examples of the functions for which a Certificate of Registration is required:

  • conducting on-site public inspections of properties for sale
  • speaking with prospective purchasers about properties for sale and prices
  • obtaining lease details from prospective lessees, preparing leases and bond rental forms, and issuing receipts
  • showing prospective tenants over managed properties (even when there are no on-site or off-site conversations with them)
  • conducting inspections of properties and prepares reports as part of property management services
  • organising insurances for managed properties and lodges claims on behalf of the owner
  • taking complaints from lessees or organises repairs to managed properties
  • obtaining "for sale" and leasing listings
  • controlling the maintenance schedule for a managed property


How long is the Certificate of Registration valid for?

Your Certificate of Registration must be renewed every year on the anniversary of its issue date if you wish to continue to work in a real estate office and perform the functions of a real estate agent (as defined by the Act). To renew, you must have fulfilled the CPD requirements applicable to your Certificate.

Who is eligible to apply for a Certificate of Registration?

To be eligible for a Certificate of Registration, you must:
    be at least 16 years old
    be a fit and proper person
    hold the necessary educational qualifications
    not be a disqualified person (relevant disclosures are in the application form)

How do I obtain a Certificate of Registration?

You need to undertake the NSW 91086 Course in Property Practice (Real Estate) prescribed by the OFT.

This course includes the following modules:
    NSW17319A Work in the real estate sector
    NSW17319B Prepare for work in the property industry
    PRDRE35A Communicate effectively and accurately with clients

Am I able to apply for RPL/RCC?

You can apply for recognition for all topics but there are set requirements for eligibility. If you think you may be eligible for Recognition of Prior Learning (RPL) or Recognition of Current Competencies (RCC) call us on 02 9891 4411 and we’ll be happy to help you figure it out.

How are the courses offered by Smart Academy undertaken?

You can do most of our courses by distance education or in seminar courses. In distance education we’ll send you paper-based manuals to complete and return to us for assessment.

How long will it take?

You should be able to complete the NSW91086 Course in Property Practice by Distance Education in less than three months. Alternatively, the seminar course runs for 3 days.

How will I be assessed?

Assessment is continuous throughout each unit to reinforce your learning using competency based strategies.

Workshop course

The 3 day course includes a combination of assessment activities completed during the course and later at home. After completing the ‘at home’ activities, simply mail them to us and you will be assessed as ‘competent’ or ‘not yet competent’ within 2 weeks. You’ll receive feedback on your assessments and a Statement of Attainment after achieving ‘competency’.

Distance education

After completing a unit, simply mail assessment activities to us and you will be assessed as ‘competent’ or ‘not yet competent’ within 2 weeks. You’ll receive feedback on your assessments and a Statement of Attainment after achieving ‘competency’.

How do I enrol?

Do I need to keep a record of my training?

YES! You should keep the originals of the Statement of Attainment or other documentary evidence for your own records. After you receive the Certificate of Registration from OFT, you will need to undertake Continuing Professional Development training to renew your Certificate. OFT requires you to keep detailed records of your CPD training for three licence renewal periods.

So is real estate training compulsory if I need a Certificate of Registration?

YES. Not only must you obtain the specific qualifications for your initial Certificate of Registration BUT you must successfully complete professional development training in each year the Certificate is current and renewal is sought.

How do I obtain training and what proof do I get?

Smart Academy can provide you with all the training you need. We will issue you with a Statement of Attainment on completion of the NSW91086 Course in Property Practice. For the CPD training you must undertake each year, Corum Training will issue the appropriate documentation for your record-keeping purposes.

What are the simple steps I can follow to get a Certificate of Registration and start work in real estate?

Complete the Course and obtain your Statement of Attainment

Complete and lodge the Application Form for the Certificate of Registration with the Office of Fair Trading together with the Statement of Attainment from Corum Training

On being offered work with a licensed real estate agent notify the Office of Fair Trading using a letter from the employing licensee.

How much time do I have to complete a unit?

There is no specific time prescribed for the completion of this course by Distance Education but you should be able to complete it in a few weeks. Take home activities from the course seminar should be completed and submitted within 2 weeks of course completion.

Are there exams?

No – all assessments are included in the unit activities. You undertake these in your own time and return them to us for assessment.

What happens if I fail?

Assessment is “competency-based” – you are deemed to be either “competent” (C) or “not yet competent” (NYC). If there is a determination of NYC, you will be given an opportunity to address the specific areas of concern again, with support and assistance from Smart Academy assessors to ensure you understand the required outcomes.

What is your refund policy?

A refund will only be issued if:

You have overpaid and have supporting documentation as proof.

You withdraw from a program more than seven (7) days before commencement (a 20% administration fee may be deducted).

No refund will be issued if:

You’ve commenced a course that you’re unable to complete.

You’ve received the training material.

What are my payment options?

We require payment for modules in advance of them being sent out to course participants for completion.
